Founding Member
Alberthe Bernier is the founding member of Bernier Law Firm. Prior to establishing her law practice, she was Senior Counsel at Riker Danzig Scherer Hyland & Perritti LLP and The Ettinger Law Firm where she successfully represented individuals and families in the areas of Estate Planning, Probate, Trust & Estate Settlement, Guardianship, Medicaid Planning and Special Needs Planning. Alberthe has exclusively practiced as an Estate, Probate, Trust and Elder Law attorney since 2009, and understands the challenges and pressures that comes with every case. Alberthe assists her clients as follows:

Prepare estate planning documents (from basic to complex), including, but not limited to: Wills, Trusts (i.e.: Revocable, Irrevocable, Medicaid Asset Protection Trusts, Minor's Trusts), and Advance Directives;

Counsel executors, administrators, trustees, and guardians on the administration and taxation of their or their ward’s estates;

Counsel trustees and trust beneficiaries on the administration and taxation of trusts;

Prepare Petitions for Probate and/or Intestate Estate Administration to help individuals obtain court appointment in order to access and/or sell a decedent's assets;

Represent individuals in guardianship proceedings, including Article 81, Article 17, Article 17A;

Advise individuals and families on how to best protect assets (such as their homes) from rising long-term care costs;

Provide legal recommendations on the appropriate Medicaid planning strategies to implement when one is faced with the need to pay for long-term care (either in home care or nursing home care);

Advise disabled individuals and their family members on special needs planning; and
-
Negotiate Medicaid claims with NYS Department of Social Services/NYC Human Resources Administration.

Alberthe received both her undergraduate and law degree from St. John's University. She is a member of the New York State Bar Association, Elder Law & Special Needs Section, and the Trust & Estates Section. She is admitted to practice in New York and is pending admission in Connecticut.

Alberthe enjoys traveling and spending time outdoors with her husband, Peter, and their two young children.
